Waiver and Release of Liability

My stay at Legacy Lodge is included as part of a Fellowship of the Sword Event and I acknowledge and agree that Fellowship of the Sword (FTS, aka The Quest Life) has the sole responsibility for the Event except for lodging which FTS has contracted for and Legacy Lodge provides as a volunteer of FTS. I agree that this Waiver and Release is in addition to and supplements the General Release of Liability Agreement I have signed with Fellowship of the Sword when registering for the Event and further agree all aspects of my presence at Legacy Lodge (on or off site) is covered by that General Release of Liability Agreement.

1. By signing this Waiver and Release of Liability (Agreement), I waive and release the owners of Legacy Lodge, Legacy Cabins, and One Legacy, Inc., its agents, officers, directors, board members, servants, employees, insurers, successors, Lessors, affiliated companies, and assigns (hereinafter “One Legacy, Inc.”) from any and all claims, demands, causes of action, damages or suits at law and equity of any kind, including but not limited to claims for personal injury, including, but not limited to death or illness, property damage, medical expenses, loss of services, on account of or in any way related to or growing out of my presence or involvement at Legacy Lodge or Legacy Cabins (whether on the property or off the property) and including, but not limited to, transportation of any kind or character during my stay. I will assume the risk associated therewith, whether known or unknown to me at this time. This release includes all claims of my family, estate, heirs, personal representatives or assigns.

I will not hold or attempt to hold One Legacy, Inc. liable for any loss, damage or injury to person or property caused by any act or neglect of other persons on or about the Property, or caused in any manner other than the willful or negligent act of One Legacy, Inc., its agents and employees, and will indemnify and hold One Legacy, Inc. harmless from any liability for damages or claims against One Legacy, Inc. arising out of or in any way related to any such loss, damage, sickness or injury.

I further covenant and agree not to institute any claims or legal action against One Legacy, Inc. or the owners of any property or vehicle associated with my stay at Legacy Lodge or Legacy Cabins for any claim released by this Agreement. I further agree that should any claim be made in contravention of this Agreement, including but not limited to derivative claims, I will protect, defend and completely indemnify (reimburse) One Legacy, Inc., the owners of Legacy Lodge, and the owners of any property or vehicle associated with my stay for any such claim and expenses including attorney’s fees and costs incurred in defending themselves or security indemnity hereunder.

2. I acknowledge and agree that One Legacy, Inc. is not responsible for any lost, stolen, or damaged valuables or property.

3. Use of off-highway vehicles (OHVs, aka off-road vehicles) on the property is strictly prohibited – all risk of use of OHVs is the sole responsibility of the user.

4. I acknowledge that I will abide by the rules and regulations governing the use of Legacy Lodge or Legacy Cabins, Fellowship of the Sword, local regulations and laws, and will honor all fire bans.

I am entering into this Agreement freely, voluntarily, and competently.

I am at least eighteen (18) years of age.

I am agreeing to these terms on behalf of myself and my spouse.
